DMV Revocation Dismissed After Hearing

*This is a second dismissal this month for officer no showing.* Our office recently represented a client in an administrative license revocation proceeding arising from a DUI arrest.

At the Division of Motor Vehicles hearing, we subpoenaed the arresting officer to appear and testify. The State did not present the necessary officer testimony to establish the basis for revocation. We objected to further delay and moved to dismiss.

The Hearing Officer dismissed the administrative revocation with prejudice.

As a result, the client's driving privileges were may be restored..
