Motion to Suppress Granted – DUI Case Dismissed

In a recent district court case in Southeast Alaska, the firm successfully litigated a motion to suppress evidence in a DUI prosecution. The court found that law enforcement unlawfully reinitiated contact with the defendant after an initial stop had concluded and directed him to exit a tent without a warrant, valid consent, or exigent circumstances.
Because the subsequent investigation flowed from that unlawful seizure, the court suppressed the field sobriety tests and breath test results. Without the suppressed evidence, the State lacked sufficient admissible evidence to proceed, and the charge was dismissed with prejudice.
