DMV Revocation Dismissed After Hearing

Our office recently represented a client in an administrative license revocation proceeding arising from a DUI arrest.
At the Division of Motor Vehicles hearing, we subpoenaed the arresting officer to appear and testify. After prior continuances, the officer was again unavailable. We objected to any further delay and moved to dismiss.
The Hearing Officer dismissed the administrative revocation.
As a result, the client's driving privileges were restored.
Administrative proceedings are separate from the criminal case and involve different burdens and procedures. Timely objections and preparation matter.
