Our office recently represented a client in an Alaska DMV administrative license revocation proceeding arising from a DUI arrest.

The central issue at the hearing was whether the evidence established that the client had operated the vehicle. We called and cross-examined the involved officers, focusing closely on the difference between what they allegedly observed and what they inferred from the surrounding circumstances.

After hearing the testimony and considering the evidence, the hearing officer dismissed the revocation, finding insufficient evidence of operation. As a result, the DMV administrative action was dismissed and the client's driving privileges were restored, if otherwise eligible.

Administrative DMV proceedings are separate from any criminal case arising from the same incident. Every case depends on its particular facts and evidence, and past results do not guarantee future outcomes.
