Our office recently represented a client in an Alaska DMV administrative license revocation proceeding arising from a DUI arrest.

The case involved a breath alcohol test and records concerning the DataMaster instrument used during DUI processing. At the administrative hearing, we challenged the State's evidence and developed issues concerning the breath-testing process and the instrument records. Additional evidence relating to those issues was submitted for the hearing officer's consideration.

After considering the evidence, the Alaska DMV dismissed the administrative revocation action. As a result, the client's driving privilege was restored, if otherwise eligible and upon proper application.

The DMV's decision did not state the specific basis for the dismissal. Administrative license proceedings are separate from the related criminal case and have their own evidentiary and procedural requirements. Careful review of breath-test records, instrument documentation, police reports, and the circumstances of the testing can be important when evaluating an Alaska DMV license revocation.
