DMV Refusal Revocation Dismissed

We recently represented a client in an Alaska DMV administrative license revocation proceeding arising from a DUI arrest and an alleged refusal to submit to a breath test.
After a contested administrative hearing, the hearing officer dismissed the DMV revocation action. As a result, the client avoided the administrative license revocation and was able to preserve driving privileges, subject to ordinary DMV eligibility requirements.
Administrative license revocation proceedings are separate from criminal court proceedings. They involve different rules, timelines, burdens, and evidentiary issues than the criminal case. Careful review of the DMV paperwork, police reports, and hearing evidence can make a significant difference in protecting a client's license.
