Our client was indicted for Assault in the Third Degree, a felony charge arising from an alleged DUI-related vehicle collision in Anchorage. The State alleged that the client recklessly caused physical injury by means of a dangerous instrument.

After reviewing the grand jury transcript, the defense filed a motion to dismiss the indictment, arguing that the State had not presented sufficient evidence of recklessness. The court agreed and granted the motion. 

The felony assault indictment was dismissed.
