DMV Revocation Dismissed After Hearing

Our office successfully represented a client in an administrative license revocation proceeding arising from a DUI arrest.
At the Division of Motor Vehicles hearing, we subpoenaed the involved officers to appear and testify. The officers failed to show and offer testimony to establish the basis for revocation. We objected to any further delay and moved to dismiss.
The Hearing Officer dismissed the administrative revocation.
As a result, the client's driving privileges may be restored, assuming all reinstatement requirements are satisfied.
Administrative license proceedings are separate from the criminal case and involve different standards and procedures. Timely hearing requests, preparation, and proper objections can make all the difference.
