Second-Offense DUI Reduced to Reckless Driving; DMV Revocation Dismissed
November 2026
We represented a client facing a second-offense DUI in Anchorage. Following negotiations with the Municipality, the charge was reduced to reckless driving, avoiding a DUI conviction.
The case involved among other issues, an independent chemical test's advisement that was questionable.
Following the criminal resolution, the Alaska Division of Motor Vehicles also dismissed its administrative license revocation action. The DMV dismissal resulted from the reckless driving judgment rather than a separate ruling following a contested administrative hearing.
